We are not responsible for delays or failures resulting from events beyond our reasonable control, including carrier delays, customs delays, natural disasters, severe weather, labor disputes, supply shortages, utility or telecommunications outages, cybersecurity incidents, government actions, or other similar events.

Product pages are likewise managed and owned by MagicRealm.

The name Shopify, its logo, product and service names, designs, and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans appearing on the Services are trademarks of their respective owners.

MagicRealm is powered by Shopify, which enables us to provide the Services to you.

However, any purchase or sale conducted through our store is a direct transaction between you and MagicRealm.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of sales transactions between you and MagicRealm, including any injury, damage, or loss resulting from the purchase of products or services.

You expressly release Shopify and its affiliates from any claims, damages, and liabilities arising out of or relating to purchases and transactions between you and MagicRealm.

(e) Use any robot, web crawler, scraping tool, data collection or extraction tool, automated device or process, AI tool (including agentic AI), or any automated or manual means to access the Services; or

This includes, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise.

We are also not liable for any claims relating to your use of the Services or any products, including but not limited to errors or omissions in any content or products made available through the Services, or any loss or damage of any kind resulting from the use, publication, or transmission of any content or products through the Services, even if we have been advised of the possibility of such damages.

Nothing in these Terms of Service excludes or limits liability that cannot be excluded or limited under applicable law.

18. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless MagicRealm, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from and against any losses, damages, liabilities, or third-party claims, including reasonable attorneys' fees, arising out of or relating to:

(2) Your violation of any law or the rights of a third party; or

We will notify you of any indemnifiable claim, except where a failure to provide timely notice causes you material prejudice. Such failure will not relieve you of your obligations unless it causes you material prejudice.

You and MagicRealm agree that such courts will have jurisdiction over the parties and the subject matter of the dispute.

Nothing in this section limits your right to bring a claim in your local courts or rely on mandatory laws applicable in your place of residence.

23. TRANSLATION

These Terms of Service may be made available in languages other than English.

If there is any inconsistency or conflict between the English version of these Terms of Service and a version in another language, the latest English version will prevail.

Unless MagicRealm decides otherwise in its sole discretion or applicable law requires otherwise, any dispute arising out of these Terms of Service will be resolved in English.
